Traditional Contemporary Bathrooms (tc bathrooms) has launched legal proceedings against Vogue Bathroom and Tiles Limited, Vogue Bathrooms Limited and individuals associated with those companies.
In a bid to protect its 'Mini' range, following the manufacture and sale by Vogue of its 'Zero' range, tc bathrooms alleges that the Zero range is 'identical to and/or substantially similar to its Mini suite'.
tc bathrooms' position is that Vogue has unlawfully copied the Mini and that this infringes tc's design rights in this product and that in doing so, Vogue used photographs of tc bathrooms' Mini range to advertise its Zero range products.
Tc bathrooms was granted an application that until such time as the matter reaches trial, Vogue will be prohibited from selling, supplying, advertising or promoting the Zero range and that Vogue be prevented from using any photographs of tc bathrooms' Mini in its literature.
The legal hearing dealt only with tc bathrooms' application for an injunction against Vogue and all matters will now be dealt with at trial next year when a final decision will be made by the court as to whether tc bathrooms is correct in its allegations. However, tc bathrooms claims the court clearly indicated that it believed that its case had sufficient merit to justify an injunction being granted.
